1. Agreement to Terms

By accessing or using the Fitted web application (the “Service”) operated by Fitted (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Fitted is an AI-powered platform that helps users tailor their resumes to specific job descriptions, analyze keyword matches, generate cover letters, prepare for interviews, and track applications. The Service uses artificial intelligence to process user-provided content and generate suggestions and tailored documents.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information.
Maintain the security of your password and account.
Accept responsibility for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

Upload or transmit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Impersonate another person or entity, or falsely represent your qualifications or experience.
Upload malware, viruses, or any other malicious code.
Attempt to gain unauthorized access to the Service or its related systems.
Use the Service for any purpose that violates applicable laws or regulations.
Scrape, crawl, or use automated means to access the Service without our prior written consent.
Resell, redistribute, or commercialize any part of the Service or its output without our express permission.
Generate resumes or content that contain materially false or misleading information about your qualifications.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence (Anthropic Claude) to generate tailored resumes, cover letters, interview questions, match scores, and other content. You acknowledge and agree that:

AI may produce inaccurate content. AI-generated suggestions, scores, and text may contain errors, inaccuracies, or biases. You are solely responsible for reviewing, editing, and verifying all output before use.
No guarantee of results. We do not guarantee that using the Service will result in job interviews, offers, or employment. Match scores and suggestions are estimates and should be treated as guidance, not definitive assessments.
Professional advice. The Service does not constitute professional career counseling, legal advice, or employment advice. Consult a qualified professional for specific career guidance.
User responsibility. You are responsible for the accuracy of any resume, cover letter, or other document you submit to employers, regardless of whether it was generated or modified by the Service.

6. Intellectual Property

6.1 Your Content

You retain all rights to the content you upload to the Service, including your resumes, job descriptions, and any other materials. We do not claim ownership of your content. By uploading content, you grant us a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service.

6.2 Our Content

The Service, including its design, features, code, documentation, and branding, is owned by Fitted and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.3 AI Output

You own the output generated by the Service based on your input (tailored resumes, cover letters, etc.). We retain no rights to AI-generated output specific to your content.

7. Subscription Terms

7.1 Plans and Pricing

We offer Free, Pro, and Premium subscription plans. Features and pricing for each plan are described on our Pricing page. We reserve the right to modify pricing with 30 days' notice.

7.2 Billing and Auto-Renewal

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing period. You will be charged the then-current price unless you cancel before the renewal date. You authorize us to charge your payment method on file for recurring fees.

You can cancel your subscription at any time from your account settings page. Cancellation takes effect at the end of your current billing period.

We will notify you by email at least 7 days before any price changes take effect.

7.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

You will retain access to paid features until the end of your current billing period.
Your account will revert to the Free plan at the end of the billing period.
No partial refunds will be issued for unused time in the current billing period.

7.4 Refunds

We offer a full refund within 7 days of your first subscription payment if you are not satisfied with the Service. After the 7-day period, all payments are non-refundable. To request a refund, contact support@fitted.ai.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Fitted, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.
Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fitted and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

Violation of these Terms.
Fraudulent, abusive, or illegal activity.
Non-payment of subscription fees.
Extended periods of inactivity (12+ months).

Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination by contacting us. After 30 days, we may delete your data.

11. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction and venue of such courts.

Before filing a formal legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@fitted.ai. We will attempt to resolve the dispute within 30 days.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fitted regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications.
